1. Agreement to Terms

This website (the "Site") is owned and operated by Naughty Bit ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our Site and the booking of our professional audio services ("Services"). By booking a session or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Studio Bookings and Payments

Our goal is to ensure a professional and transparent booking process.

• Booking Confirmation: A booking is confirmed only upon receipt of a 50% deposit of the total quoted fee. This deposit is non-refundable. The client agrees to pay the remaining balance upon completion of the booked session(s).
• Session Time: Session time begins at the scheduled start time and ends at the scheduled end time. This includes setup, breakdown, and any breaks. Overtime is subject to engineer availability and will be billed at our standard hourly rate.
• Cancellation Policy: Cancellations made less than 7 days prior to the scheduled session will forfeit the deposit. We will make reasonable efforts to reschedule a session if notified in advance, subject to studio availability.
• Payment Methods: We accept payment through the methods specified in our official invoice. All transactions are secure.

3. Studio Use and Client Responsibility

We strive to maintain a creative, safe, and professional environment.

• Client Conduct: Clients and their guests agree to behave in a professional and respectful manner. Any behavior that endangers our staff, equipment, or facility may result in immediate termination of the session without a refund.
• Equipment Damage: The client is responsible for any damage to studio equipment, instruments, or property caused by them or their guests due to negligence or misuse.
• Food and Drink: Food and drink are permitted only in the designated lounge area. No food or open-lid drinks are allowed in the control room or live room near the equipment.

4. Project Files and Data Storage

We are committed to the security of your creative work.

• Data Backup: Naughty Bit will perform backups of session data during active projects. However, we are not responsible for the long-term storage of your project files.
• File Delivery: Upon receipt of final payment, we will deliver the final master files and, if requested, the multi-track session files via a secure cloud service.
• Storage Policy: Clients are responsible for securing their own copies of all project files upon delivery. We do not guarantee the storage of session files beyond 60 days after project completion unless a separate storage agreement is made.

5. Intellectual Property and Credits

You, the client, retain full ownership of the copyright for your musical compositions and sound recordings ("Creative Assets").

• Ownership: All rights to the Creative Assets created during your session belong to you upon full payment for our Services.
• Studio Credit: For any commercial release of work recorded, mixed, or mastered at our studio, you agree to provide appropriate credit to "Naughty Bit" and the specific engineer(s) involved. For example: "Recorded by at Naughty Bit."
• Promotional Use: We reserve the right to use the client's name, likeness, and short (15-30 second) clips of the final audio for our own promotional purposes (e.g., on our website's "Work" page), unless otherwise specified in writing. We will never release full, unreleased tracks.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NAUGHTY BIT AND ITS EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR CREATIVE OPPORTUNITY, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR BOOKING SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE SERVICE IN QUESTION.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice by updating the "Last Updated" date at the top of this page. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
